IDEAL CANDIDATE STATEMENT The ideal candidate for the General Attorney (Labor) (Resident Agent) will have experience preparing legal documents, including memoranda, motions, or briefs, and presenting arguments or making presentations on factual and legal issues. Knowledge of the National Labor Relations Act or similar related statutes is preferred. Excellent communication and interpersonal skills to interact with witnesses, opposing counsel, colleagues, and senior-level management; and strong research and analytical skills are desired. Must be flexible and willing to travel as needed to fulfill job responsibilities. BASIC REQUIREMENTS Education: Must have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have the first professional law degree (LL.B. or J.D.). Law school transcripts must be submitted at the time of application. Bar Membership and Certification: Must currently be a member in good standing of the bar of a state, territory, or commonwealth of the United States, District of Columbia, or Commonwealth of Puerto Rico. Your active Bar license must reference Bar number and indicate the status of good standing. Agency Internal Self-Certification Forms are not acceptable for verification. In addition to the BASIC REQUIREMENTS, applicants must also meet the following: MINIMUM QUALIFICATIONS Applicants must have one year of specialized experience, equivalent to the GS-13 grade level, which has provided them with the knowledge, skills, and abilities to successfully perform the duties of a General Attorney (Labor) (Resident Agent) at the GS-14 grade level. Specialized experience includes: Experience conducting legal research to identify and support the resolution of legal issues; and Experience working with labor, employment, or administrative law to render resolutions in cases; and Experience managing complex or sensitive cases with a high degree of independence. This experience must be fully supported and articulated in your resume to receive consideration. This position serves as a Resident Agent in Jacksonville, FL, reporting to Regional Office 12 Tampa, in Tampa, Florida, of the National Labor Relations Board. The purpose of this position is to carry out a variety of assignments including the analysis and recommendation as to proper course of action in the most difficult and complex cases filed in the regional office under the provisions of the National Labor Relations Act, as amended.
  • As a General Attorney (Labor) (Resident Agent), GS-0905-14, your typical work assignments may include: Assignments requiring expedited preparation, intensive legal research, preparing detailed factual and legal reports and analyses involving factual and legal questions, conflicting legal precedents, controversial areas of labor relations, or other factors rendering resolution of difficult or sensitive cases. Independently investigating and analyzing broad assignments by interviewing and obtaining affidavits from the parties and witnesses; reviewing and analyzing relevant records in order to make recommendations. Engaging in: (1) making on-the- spot decisions and exercises judgment in unfair labor practice charge investigations, (2) unfair labor practice trials, (3) representation case investigations, (4) hearing officer in pre-election representation case, 10(k) investigations and hearings, post-election representation case proceedings, conducting bargaining unit elections, and when directed conducting analysis of Board Agent files. In consultation with a supervisor, conducts federal court litigation involving injunctions under provisions of the National Labor Relations Act, as amended, and related proceedings involving the Board and its agents in the United States District Courts, civil in the United States District Courts and Courts of Appeals, subpoena enforcement proceedings, claims in bankruptcy proceedings, and other litigation in support of the Agency's compliance program. Independently tries unfair labor practice cases before Administrative Law Judges, including examining and cross-examining witnesses, introducing evidence and exhibits, lodging appropriate objections, and arguing motions made by the parties, prepares post-hearing briefs or presents a closing oral argument to the Administrative Law Judge. Making recommendations to the Regional Director concerning investigation and/or the settlement of unfair labor practice charges or whether representation cases should proceed, including examining the showing of interest presented in certain types of cases and negotiating appropriate Consent or Stipulated Election Agreements.
